Responsibilities
- Review the request, ensure that allresponsive records is in the case file, and obtain missinginformationifnecessary,
- ThroughtheapplicationoftherulessetoutintheAccesstoInformationActandthePrivacyAct,determinethestatutoryrightoftherequestertohaveaccesstofederalinformationandtosimultaneouslyprotecttheprivacyofindividuals,
- Analyze the content of recordsor disclosure packages to resolves complex, controversialandhighlysensitivecaseswhichmayrequireconsultationandresolutionofissuesinvolvingtherequesters,thirdparties,otherfederalinstitutionsandothergovernments,international,provincialormunicipal,
- AnalyzeRCMPinformationanddocumentationfordisclosuretorequestersortheirappointedrepresentatives,
- Identifyduplicateandnon-relevantrecordsandsupportthesedecisionswithdocumentedjustification,
- Assimilate and synthesizeinformation from a range of sources (e.g., access and privacyissues and related legislation,regulations, jurisprudence, central agency policies andguidelines)toformulateareasonedRCMPpositioninsupportofexemptionandexclusionprovisionsoftheAccesstoInformationActandthePrivacyAct.
Positionsadoptedmustbesustainableinlaw,
- DeveloprecommendationsandrationalesontheinterpretationoftheATIPlegislationrelatingtohighlysensitivecasesfortheBranch,
- Prepareproposeddisclosurepackagesforreviewbythedelegatedmanager,
- UpdatetheRCMPAPCMsystemforallactionstakenonfile(s),
- Provide adviceto RCMP staff, stakeholders, and requesters on the interpretation andapplicationoftheAccesstoInformationActandthePrivacyActandrelatedinstruments,
- ConductresearchandanalysisinthepreparationofATlP-relatedcorrespondence,
- LeadconsultationswithothergovernmentagenciesandthirdpartiesconcerningperceivedrisksthatmaybeassociatedwiththereleaseofinformationfoundinRCMPfiles,
- WritememorandaandcorrespondencepertainingtotheprocessingofAccesstoInformationActandPrivacyActrequests;and
- Decisions / recommendationsondisclosureornon-disclosureofinformationmustbemadewithinthelegislativerequirementsoftheAccesstoInformationActandthePrivacyAct.
TheContractor'sresourcesmayberequiredto :
- Negotiate, develop and implementstrategies for the resolution of complaints underinvestigationbytheOfficeoftheInformationCommissionaireandtheOfficeofthePrivacyCommissioner,
- DelivertrainingonAccesstoInformationActandPrivacyActrequirementsandrelatedTreasury BoardSecretariatguidelines,directivesandpolicies,
- If required, explain the RCMP'sposition in order to satisfy the investigation on thecorrectnessoftheactiontakenbytheRCMP,andnegotiatearesolutionthattheOfficeofInformation Commissionaireand / or the Office of Privacy Commissioner, and the RCMPdeemsatisfactorytoresolvethecomplaint,and
- Instanceswherelegislationisunclearordoesnotspecificallyaddressagivensituation;wheretheholderoftherequestedinformationisadamantaboutexemptingorexcludinginformation,theContractor'sresourceswillensurethattheissueisescalatedwithintheRCMPATIPmanagementstructureforresolution.
Qualifications
Must demonstrate that each of theproposed resources have ten (10) years ofexperience, prior to bid closing, inreviewing allof the following :
Processingaccess to information (ATIP)requestsand files at the Canadian FederalGovernmentlevel,andProvincialAffairs;and
Access toinformation request exceeding1,000pagesin size.
Must demonstrate that each of theproposedresourceshaveexperienceinproviding
recommendationsto ATIP Coordinators.
Must demonstrate that each of theproposed resources have experience inaddressingcomplaintsfromallofthefollowing :
TheOffices of the InformationCommissionerand Privacy Commissioner,and
Defendexemptions applied under the Actswhichresulted in successful resolution.
Must demonstrate that each of theproposed resources have experience usinganATIPCaseManagementSystem(APCM)inthe
CanadianFederal Government.
MUST CURRENTLY HOLD VALID GOVERNMENT RELIABILITYSTATUS
