What Is The Opportunity?
Aecon is currently seeking a Senior Commercial Manager to join the GO Rail Expansion (RER) project, located in the Greater Toronto Area.
This transformational project is the largest capital infrastructure project in Ontario’s historic GO Rail Expansion program!
What You Will Do Here :
- Manage changes, including schedule and costs.
- Implement an effective system to ensure all contractually-required notices are delivered to the client in accordance with the project agreement.
- Administer project contracts (project agreement, subcontracts, consultancy agreements, purchase agreements, etc.), ensuring all contract deliverables and timelines are met.
- Lead the drafting, review, and negotiation of various contracts (with clients and subcontractors), including specific service contracts, master services agreements, commissioning contracts, engineering contracts, settlement agreements, non-disclosure agreements, construction contracts, and procurement contracts.
- Implement and monitor procurement scheduling and plans, facilitating a competitive tendering process for materials, goods, services, and equipment, including the development of terms and conditions, scope, and specification requirements.
- Issue regular reporting and analytics on commercial issues to Executives (internal and JV ExCo) and Project Managers.
- Engage with the project's insurance advisors to develop appropriate project insurance programs and coverages.
- Exercise proper judgment by engaging with the project's legal advisors for advice at appropriate times.
- Develop a risk management and mitigation plan to identify potential events (internal and external) that may hinder the project’s objectives and monitors measures to mitigate the exposure to those risks.
- Oversee the commercial management of project closeout / post-practical completion, including the defect liability period and O&M.
- Lead and aligns a team of commercial direct reports to the project and its priorities by focusing the team’s activities and holding individuals accountable for results.
- Drive an inclusive culture to promote equity, welcome different perspectives, and enable career progression by fostering a sense of belonging.
What You Bring To The Team :
- 15+ years experience working for a Contractor.
- Minimum of 5 years commercial management experience on major projects.
- Legal, Engineering, or Quantity Surveying degree or equivalent.
- Demonstrated experience working under a variety of contracts (Design Build, Lump sum, unit price).
- Sound understanding of construction methodology and process in a large, complex operating environment.
- Thorough knowledge of change management principles including identifying significant variations, claims identification, quantification and evaluation.
- A sound understanding of construction law, combined with a detailed appreciation of contractual obligations and liabilities, commercial and financial functions (i.
e. project cash flow).
- Direct experience with the tendering process, contract administration, budgetary cost value and reduction capability, procurement and subcontract administration, earned value management, Aconex, and P6 scheduling software (preferred).
- Experience with risk identification and risk management (preferred).
- Experience in liaising with client, subcontractor and consultant representatives.
- Basic understanding of insurance program requirements for various project types and advise on suitability of corporate programs vs project specific requirements.
- Excellent organizational, communication, and writing skills.
- Excellent people and leadership skills.
- Proficiency on MS Office suite.
- Self-motivation with good organizational skills.
- Ability to work accurately under pressure.
- Adaptability to flexible work schedule when required to meet deadlines.
